These are the terms a careful record keeper would want stated plainly. Please read them — by using larkfen.com (the "Site") or placing an order, you agree to them.

1. Who can use the Site
You must be at least 18 and able to form a binding contract. By placing an order you confirm that the information you give us is accurate and that you're authorized to use the payment method.

2. Everything is made to order
This is the most important thing to understand about Larkfen, so we say it up front:
Every Larkfen piece is made to order. We hold no inventory. When you place an order, your tee, cap, poster, or framed plate is printed, pressed, or framed for you by our fulfillment partner after you check out. Production begins shortly after your order is confirmed.
Because each item is produced individually:
- There is a short cancellation/change window after you order (see §4).
- Returns are limited compared with a stocked retailer (see our Refund Policy).
- Slight, normal variation in color, fit, and finish is expected (see §7).

3. Orders, pricing & acceptance
- All prices are in USD and shown on each product page. Current Drop-1 pricing is listed on the Site.
- Taxes are calculated at checkout where applicable; shipping is shown before you pay. Free US shipping applies on orders over $95.
- Placing an order is an offer to buy. We accept it when we send an order confirmation and begin production. We may decline or cancel an order — for example, if an item is unavailable, a price or description was clearly wrong, payment fails, or we suspect fraud. If we cancel after charging you, we'll refund you in full.
- We do our best to describe products accurately, including binomial names, field data, materials, and fit. Despite our care, listings may occasionally contain an error; we reserve the right to correct it.

4. Cancellation & changes
Because production starts quickly on a made-to-order item, your window to cancel or change an order is short.
- You may cancel or change an order within 24 hours of placing it, provided it has not yet entered production, by emailing hello@larkfen.com with your order number.
- Once an item has entered production, it generally cannot be cancelled, changed, or returned for change-of-mind, because it is being made specifically for you. Defects and misprints are always covered — see the Refund Policy.
> Review note: Set the exact cancellation window to match your fulfillment partners' real production timing (Printify / SwiftPOD / Printful / Sensaria / Jondo). Confirm the window is consistent across Terms, the Refund Policy, and any checkout messaging.

5. Shipping & delivery
- Production typically takes 2–4 business days; US delivery is typically 5–8 business days total, with tracking.
- Title and risk of loss pass to you when the carrier accepts the shipment.
- Delivery estimates are estimates, not guarantees; carrier delays are outside our control. Full details are on our Shipping & Returns.
- International shipping (where offered) may incur duties or import fees, which are the recipient's responsibility.

6. Payment
Payments are processed by Shopify Payments. By submitting payment you authorize us (and our processor) to charge the full order amount including tax and shipping. We don't store full card numbers.

7. Product variation & color
Larkfen tees are garment-dyed and our prints are made on natural materials, so minor variation is part of the product, not a defect: dye lots, wash, and screen calibration mean colors and placement can differ slightly from the images on your screen. Hand-finished and made-to-order goods carry small, expected differences. This normal variation is not grounds for a refund. Genuine defects and misprints are — see the Refund Policy.

8. Intellectual property
All Larkfen designs, plates, data-viz layouts, typography systems, collection codes (e.g., LF-LIFE-001), photographs, text, and the Larkfen name and marks are original works owned by us or our licensors and are protected by copyright and trademark law. Our designs are original IP — they do not reproduce or claim affiliation with Audubon, Sibley, Peterson, eBird, Merlin, or any third-party mark.
You may not copy, reproduce, resell, or create derivative works from our content without written permission. Buying a product gives you the product — not a license to its artwork.

9. Acceptable use
Don't use the Site to break the law, infringe others' rights, transmit malware, scrape or harvest data, interfere with the Site's operation, or attempt unauthorized access. We may suspend or terminate access for misuse.

10. User content
If you post a review, tag us, or send us photos (including for a defect claim), you grant us a non-exclusive, royalty-free license to use that content to operate and promote the store, with attribution where practical. You confirm you have the right to share it. We may remove content at our discretion. **

11. Disclaimers
The Site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties not expressly stated here, including implied warranties of merchantability and fitness for a particular purpose. We don't warrant that the Site will be uninterrupted or error-free.
Nothing in these Terms limits any non-waivable rights you have under applicable consumer-protection law.

12. Limitation of liability
To the fullest extent permitted by law, Larkfen and Larkfen will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

13. Indemnification
You agree to indemnify and hold harmless Larkfen, Larkfen, and our partners from claims arising out of your misuse of the Site, your violation of these Terms, or your infringement of any third party's rights.

14. Governing law & disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or your purchase will be resolved exclusively in the state or federal courts located in the State of California, and you consent to their personal jurisdiction and venue.

15. Changes to these Terms
We may update these Terms as the store and the law evolve. The current version is always posted here with a "Last updated" date. Continuing to use the Site after changes means you accept the updated Terms.

16. Miscellaneous
If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Site.
